BDMO wins patent case in German court
Belgian-French packaging manufacturer BDMO has won the right before a German court to market its Double Push Tray internationally without infringing Pozzoli’s European patent.
In lawsuits in the United Kingdom, France and now Germany, BDMO has successfully defended its position. The various courts have confirmed that BDMO’s Double Push Tray does not infringe the patent, thus dismissing Pozzoli’s ownership claim. Furthermore, the said patent (EP 0 676 763) was revoked in full in all three countries.
The German ruling is still subject to appeal, as is that in France, however, the decision of the British courts is already legally binding.
